The U.S. Department of Labor’s Office of Federal Contract Compliance Programs (OFCCP) issued a final rule to implement Executive Order 13665, Non-Retaliation for Disclosure of Compensation Information, in order to promote Federal contractor pay transparency.
The final rule makes several changes, including prohibiting Federal contractors from discriminating against employees or applicants who inquire about, discuss, or disclose compensation information. The rule also incorporates a prescribed nondiscrimination provision into existing employee manuals and handbooks, defines key terms, and provides contractors with two defenses to a discrimination allegation.
